DISCIPLINARY PROCEDURE FOR COMPETENT PERSONS AND VALUATORS OPERATING IN TERMS OF THE SAMREC AND SAMVAL CODE

  1. Competent Person (CP) or Competent Valuator (CV) who publishes a public report in terms of the SAMREC or SAMVAL Code shall be subject to the disciplinary procedure described below.
  2. A complaint that a CP or CV has breached the relevant code shall be submitted in writing and referred to the Ethics Committee for review within 21 days of receipt of the complaint.
  3. The Ethics Committee shall comprise of not less than three members.
  4. The Chairperson shall be a member of the SSC and is entitled to co-opt members to the committee.
  5. The duties of the Ethics Committee will be to consider all allegations of breaches of the SAMREC and SAMVAL Codes submitted to the SSC.
  6. At the conclusion of the review of a complaint the Ethics Committee may rule that the complaint has not been established, or may find that the complaint has been established.  In either case their recommendation  shall be reported to the Chairperson or failing him the Deputy Chairperson of the SSC.  
  7. Should the Chairperson or failing him the Deputy Chairperson of the SSC following due consideration of the complaint and the recommendation of the Ethics Committee, determine that the complaint has been established; he shall forward the said complaint to the relevant Disciplinary Committee.  The relevant Disciplinary Committee may be any of the following: SACNASP, ECSA, PLATO, GSSA, SAIMM or other ROPO organisation to which the CP or CV is affiliated.
  8. Should the Chairperson of the SSC following due consideration of the complaint and the recommendation of the Ethics Committee disagree with the recommendation a full meeting of the SSC shall be convened to consider the matter. The decision of the SSC shall be final.
  9. The final decision regarding a complaint shall be made within 30 days of receipt of the complaint. The decision shall be conveyed to the complainant as soon as practical thereafter.
  10. Should the complainant be a member of the SSC he shall recuse himself from the disciplinary process.
  11. The SSC will ensure that it is informed of the result of any disciplinary action resulting from the complaint.
